Court cases, Issues and Direct payment - Information from PSR
I.Pay Anomaly :
APPEAL FILED BY THE DEPARTMENT OF TELECOM AGAINST THE JUDGEMENT OF CAT PRINCIPAL BENCH IN THE CASE OF PENSION ANOMALY, FILED BY OUR ASSOCIATION AND WON BY US, CAME UP FOR HEARING IN DELHI HIGH COURT TODAY. IT CAME UP AFTER LONG TEN MONTHS. EVEN THEN, THE DEPARTMENT DID NOT COMPLY WITH THE COURT ORDERS. ADVOCATE FOR DEPARTMENT SOUGHT FURTHER TIME. A SHORT POSTPONMENT IS ALLOWED. NEXT DATE OF HEARING IS 8-2-2019.
When justice is denied by the Government we are compelled to approach the court. It is the last resort for people like pensioners. Even at that stage the Government departments can play games and delay the justice further. Latest instance is the Pension Anomaly Case that came up before Delhi high court. Last time, the high court gave a long period of ten months to the Department of Telecom to file their counter. But after ten months, when the case was taken up the Department lawyer wants more time. Of course, this time it is only 4 months’ time is given. But there is no guarantee that Department will file their counter before that date.
II.THE TWO OTHER CASES :
Our Association has filed two cases in Ernakulam CAT.
1. For getting arrears on account of 78.2% IDA revision from 1-1-2007 instead of 10.6.2013.
2. To get pension re-fixed @ 50% of last pay drawn to all BSNL retirees who retired before 1-1-2006.
CAT admitted both the cases. But, a date for hearing is not yet given by the CAT.
Reason?
There is only Judge in CAT Ernakulam bench. Only when two judges are available the case will be heard.
Government is responsible for this situation. A judge had retired in December 2017. 10 months have gone. The vacancy is not yet filled up. This is the case with Chennai bench of CAT also. It is the case with many other benches of CAT.
CAT was introduced to ensure justice as quickly as possible to the central government employees and pensioners.The very purpose is defeated by not posting sufficient number of judges.
The government, the bureaucracy, the authorities can deny justice,They can delay the justice. The ordinary people are helpless.
III. Other Issues
22-10-2018 Meeting with Director (PSU), DoT:
Today GS along with Shri S.P. Sharma GS BSNL WRU met Shri Pawan Gupta Director (PSU) DoT and enquired about the status of cabinet note for relaxation of affordability clause for implementation of 3rd PRC recommendation in BSNL. Director (PSU) DoT informed us that DoT Finance had earlier raised some points and DoT had written to BSNL for clarifying the points raised by DoT Finance. The clarification submitted by BSNL is being examined by DoT Finance. After clearance by DoT Finance, the cabinet note will be sent to all the concerned Ministries for their comments. Director (PSU), DoT assured us that all efforts are being taken for implementing 3rd pay revision in the coming months, but the main concern is the 22% fall in revenue in 2017-18 when compared to the revenue of 2016-17. In the present financial year also BSNL revenue has been coming down and this may be a stumbling block in getting cabinet approval.
Yesterday I received many calls about Pay Revision. It seems there was a wild rumour that Cabinet has approved something..
Hence I checked various websites.
It is seen that DoT has not yet finalised any Cabinet Note till this time.

IV. REDARDING DIRECT PAYMENT.
There is some confusion in the mind of pensioners about CPMS as it is being implemented in a hasty manner, without circulating a Concept Paper. Immediately, from 1-11-2018, it is implemented in the case of new retirees only. But all BSNL retirees and DoT retirees, numbering about 3 lakh will be brought under its purview from April 2019.
It is already implemented in MTNL. There seems to be no problem according to Com. S S Nanda of RTOWA, Delhi. I am told that from the very beginning MTNL retirees were getting pension directly from CCA.
A similar scheme is already implemented in Defence Ministry for 24 lakh pensioners. There also, there is no problem. That might have prompted the PMO and Minister to launch it in DoT.
We, the BSNL retirees, are in different situation. There are many authorities in our case.
(i) BSNL is the Pension Sanctioning Authority for us.
(ii) CCA is the Pension authorizing Authority.
(iii) Bank or Post office is the PDA – Pension Disbursing Authority.
Under CPMS CCA will become the Pension Sanctioning Authority also. BSNL SSA has to send the service book before retirement of an employee to the CCA.
Bank or PO is not totally eliminated from the arrangement as some people think. A pensioner will continue to get the pension through the bank or PO he has selected. Only difference is that the concerned CCA will be crediting the amount online to Pensioner’s account. In short, CCA office will take over the role of PDAs to some extent.
When IDA is increased the CCA will credit enhanced amount.
When the pension revision takes place the changes matter a lot. Now, BSNL is revising the pension, after verifying the service book etc. CCA is authorizing the same to PDAs. The Bank or the Post Office then calculates the arrears and credits the amount in the account of the concerned pensioner.
Under the new system, CCA will revise the pension, calculate the arrears and credit the amount directly in the bank account or PO SB account, as selected by the pensioners. CPPC of Banks and Director oc Postsl Accounts have no role or responsibility to calculate the arrears etc.
According to Kerala CCA, the Asst. Coordination Officer nominated by SSAs shall accept Life Certificate. But, there is no specific order for that.
Kerala CCA says that same Asst. Coordination Officers can issue Form 16 for income tax return purposes. There is no order on this too.
Given the track record of BSNL officers and our experience in pension revision with 68.8 and 78.2 and also revision of CDA pension cases we cannot believe that BSNL officers will do it to the satisfaction of pensioners.
Some of the CCAs like Maharastra, Gujarat, AP, Tamilnadu, Karnataka and Kerala deal with large number of pensioners – more than 15000. Number of AOs/AAOs sanctioned to these circles are same that of smaller circles. This has to be corrected.
Proper training has to be imparted to the staff in CCA offices and to the nominated Asst. Coordination Officers as well. Till that time the pensioners should not be asked to migrate to the new system.
In any case this should be optional.
We need not oppose any change per se. We should not accept anything blindly too.
It is true that we got indication about this one year back. In November 2017 we discussed it in Patna CWC. Nobody objected then. We wrote an editorial in January 2018 issue of Patrika also. Then also nobody objected. It is our habit. Our people used to sleep on any issue till a target date is fixed. Now 1st November 2018 and 1st April 2019 are declared. We have woken up to the dangers.
We can discuss and review the matter in next CWC. We must have a national view. All circles are not equally efficient. All banks are not equally efficient. Condition of post offices is much worse. That is the main reason why many pensioners welcome the change.
In the meantime, can our Delhi comrades take help of some BJP MPs there and meet the minister Shri Manoj Sinha and convey our apprehension? Will it be possible to get postponed the date of 1-4-2019 for extension of CPMS to the existing pensioners?

மாவட்டத் துணைத் தலைவர் திரு.என்.அம்பிகாபதி அவர்கள் கூட்டத்திற்குத் தலைமையேற்றார். கூட்டத்தில் மாவட்டத் தலைவர் எல்.தாமஸ், மாவட்டச் செயலர் எஸ்.சுப்பையா, மா. இணைச் செயலர் கே.சித்திக் உமர் ஆகியோர் சங்க வளர்ச்சி குறித்த விவாதங்களில் பங்கேற்றுப் பேசினர்.
கூட்டத்தில் கீழ்கண்டவை குறித்த விவாதங்கள் நடந்தேறின:
1.பூரி அகில இந்திய மாநாட்டின் முக்கிய நிகழ்வுகள் குறித்து தோழர்.என்.அம்பிகாபதி உரையாற்றினார்.
2. KYP விண்ணப்பங்கள் PCCA, சென்னையில் இதுவரை சமர்ப்பித்த 245 போக, இன்னமும் தராதவர்கள் குறித்த பட்டியல் விவாதிக்கப்பட்டது.
3. அடுத்த மாதம் நடைபெறவிருக்கும் செயற்குழு குறித்து விவாதிக்கப்பட்டது.
கூட்டத்தில் 15 உறுப்பினர்கள் கலந்துகொண்டனர்.

AIC NEWS AND DECISIONS
PURI AIC NEWS
ODISHSA, a small circle in size, but high in spirit, hosted our big All India Conference at a small place, Puri.
Ø Red Alert warning about a cyclone on coastal Odisha gave added burden to the hosts. With that fear and apprehension only we started the conference. But, the cyclone simply crossed over Odisha and got weakened. here were some showers and strong wind on 20,September.
Ø 1228 Delegates from 22 circles registered and participated in the conference. In addition, about 450 comrades from Odisha branches also attended the AIC.
Ø The conference adopted the Report and accounts unanimously. 49 delegates and some of the Central officers participated in the debate.
MAIN CONCERN
The delegates from every circle expressed serious concern over non-allotment of funds by BSNL for paying medical allowance and reimbursement under BSNL MRS, practically negating the order for restoration of allowance for pensioners.
GENERAL APPROVAL
All the delegates who participated in the Debate approved and supported the right demand for Pension Revision with fitment factor suggested by seventh CPC.
MAIN DECISION OF AIC
... AIC decided to organize mass Hunger Strike for one day in October/November 2018, at all SSA headquarters demanding Pension Revision with CPC fitment factor.
... AIC decided to hold a National Convention in New Delhi to draw attention of authorities on our major demand for pension revision with CPC fitment factor. We will approach other Pensioners’ organizations who agree with our demand.
... CHQ will announce the date and venue of the Convention in consultation with other organizations.
... Our members from Delhi, Haryana, Punjab, Rajasthan, UP East and UP West Circles should participate in the Delhi convention in largest number.Other Circles may send representatives.
... Cost for the participation will be borne by concerned SSA/Circle Units.
... CHQ will issue detailed instructions after finalizing the date, venue etc.
AMENDMENTS TO THE CONSTITUTION
CWC considered all proposals but recommended only two amendments. AIC approved those amendments about Branches and Quota thereon. After the amendments the position shall be as;
(i) Name of our association remains same as AIBSNLPWA. There is no change for the time being.
(ii) The District units are free to form branches below SSA Units for better and effective functioning.
(iii) If branches are formed as above, the SSA Unit shall decide jurisdiction of such branches, as already provided in the constitution.
(iv) District conference of such SSA Unit, having branches, shall comprise of delegates elected by the branches at the ratio of One Delegate for every Ten members or part thereof.
[for example: for 5-14 members one delegate to District conference, for 15-24 members 2 Delegates, for25-34 members 3 Delegates, for 35-44 members 4 Delegates, so on so forth.]
(v) The branch shall remit quota as
20% to CHQ
20% to Circle
20% to District and retain remaining 40%.
(vi) If there is no branch under a SSA Unit, the Quota will be as
20% to CHQ, 20% to Circle and 60% will be retained by the SSA Unit.
(vii) For AIC and Circle Conference, the SSA Unit shall remain as the Base unit, as now.

Though the Conference ended on time as scheduled smoothly, unexpected problems were waiting for many Delegates.Due to some agitation at Kharagpur in West Bengal, 40 trains were cancelled. Hundreds of our delegates were stranded at Puri, Khurda Road or Bhubaneswar railway stations. Some had to catch flights. Some others like Ernakulam comrades had to spend 18 hours in railway platform for their trains.Some others had to travel in unreserved coaches, having no water, no toilet facility, and no food.It was a torture. We could not help them.Nobody could help them.Railways did not make any alternate arrangement.
SHOCKING DEATH OF A VETERAN IN AIC VENUE
On 21-9-2018, when we were in CWC meeting the shocking news reached us about sudden demise of Com. P C Moitra (72), our former All India Vice President and present Circle President of West Bengal. He had heart problem and has been moving with a pacemaker. But death came so unexpectedly. He came to Puri to attend the AIC. While sitting in front of the Conference hall he fell down on the lap of a comrade from Tamilnadu and expired on the spot.
Immediately he was taken to hospital and they declared brought dead. Some comrades console themselves that he could breathe last in the “holy land” of Puri. But, it was a shock for us. I and Com. Natarajan went to the hospital, terminating the CWC meeting and located the dead body kept behind the Puri District Hospital. I could take a shot of the dead body of my old comrade with 40 years friendship, under the light provided by Com. Natarajan’s mobile phone.
The postmortem was done and the dead body was brought to the AIC venue at 1315 hours on 22-9-2018.Hundreds of Delegates paid homage and the body was sent to Calcutta in an ambulance van.Com. AK Ghosh and Com. S R Dutta who came with late Com. Moitra accompanied the dead body.CHQ met all expenses for sending the body. Red salute to com. P C Moitra. ….PSR
வணக்கம்!
இம்மாதம் 22 மற்றும் 23 ஆகிய தேதிகளில் நமது அமைப்பின் அனைத்திந்திய மாநாடு வெற்றிகரமாக ஒடிஷா மாநிலம் கோவில் நகரமாம் பூரியில் நடந்து முடிந்துள்ளது. 21 மாநிலங்களிலிருந்து 774 சார்பாளர்களும், 458 பார்வையாளர்களும் ஆக மொத்தம் 1232 உறுப்பினர்கள் கலந்து கொண்டு சிறப்பித்தனர். இதுதவிர, ஒடிஷா மாநிலத்தை சேர்ந்த 400 க்கும் மேற்பட்ட தோழர்கள் கலந்து கொண்டனர். தமிழ்நாட்டிலிருந்து 183 சார்பாளர்களும் 69 பார்வையாளர்களும் கலந்து கொண்டுள்ளனர். அகில இந்திய பொறுப்பாளர்கள் தோழர்கள் DG , முத்தியாலு , நடராஜன் , ராமராவ் , S .அருணாசலம் , மற்றும் நம் மாநில செயலர் தோழர் RV ஆகியோர் பங்கு பெற்றனர்.
மாநாட்டில் நம்மை எதிர்நோக்கியுள்ள பல்வேறு பிரச்சினைகள் குறித்து விரிவான விவாதங்கள் நடைபெற்றன.
அமைப்பு நிலை விவாதத்தில் தமிழ் மாநிலத்திருந்து தோழர்கள் N.S.தீனதயாளன் -STR , S.வீராசாமி -மதுரை, B .அருணாசலம்-கோவை , R .அசோகன்-கடலூர், ஆகியோர் பங்கு பெற்று பிரச்சினைகளை எடுத்துரைத்தனர். 22-ஆம் தேதி இரவு ஒடிஷா மாநில கலைஞர்களின் ஒடிசி நாட்டிய மிக சிறப்பாக வண்ணமிகு நிகழ்சி நடைபெற்றது.இந்த நிகழ்ச்சி அனைவரின் கண்ணையும் கருத்தையும் கவரும் வகையில் இருந்தது. அன்று இரவு உலகப்புகழ் பெற்ற ஸ்ரீ ஜெகந்நாதர் ஆலயத்திலிருந்து வரவழைக்கப்பட்ட பிரசாதம் மிகச் சிறப்பான முறையில் அனைவருக்கும் வழங்கப்பட்டது.
23 ஞாயிறு அன்றும் பல்வேறு மாநிலச்செயலர்கள் பரப்புரையாற்றினர். விவாதங்களுக்கு பதில் அளித்து பொது செயலர் தோழர் நடராஜன் உரையாற்றினார். Pension is Right என்ற புத்தகம் தோழர் DG அவர்களால் எழுதப்பட்ட புத்தகம் மாநாட்டில் வெளியிடப்பட்டது. இந்த புத்தகம் தயாரிக்க ,தயாரிப்பில் முழு முயற்சி எடுத்துக்கொண்ட அகில இந்திய துணைப்பொது செயலர் தோழர் V.V.S. மூர்த்தி அவர்களுக்கு பாராட்டு தெரிவிக்கப்பட்டது. அச்சிடப்பட்ட அனைத்து பிரதிகளும் நம் தோழர்களால் வாங்கப்பட்டு விற்று தீர்ந்து விட்டது. மிகவும் பயனுள்ள இப்புத்தகம் மீண்டும் அச்சிட்டு வெளியிட மாநிலசெயலர்கள் முன் முயற்ச்சி எடுத்து தெரிவித்தால் இரண்டாம் பதிப்பு வெளியிடுவதற்கான நடவடிக்கை எடுக்கப்படும்.
நம்மை எதிர்நோக்கியுள்ள மிக முக்கியமான கோரிக்கையான ஓய்வூதிய மாற்றம் 01-01-2017 முதல் விரைவில் பெறுவதற்கு எதிர்வரும் 2018 நவம்பர் மாதம் டில்லியில் ஒரு கருத்தரங்கம் ( convention ) நடைபெறும் அதைத் தொடர்ந்து அனைத்து மாநில , மாவட்ட தலைநகரங்களில் ஒரு நாள் உண்ணாவிரதம் மேற்கொள்ளப்படும் என்று தோழர் DG முன்மொழிந்த தீர்மானம் ஒரு மனதாக பலத்த கரவொலிகளுடன் ஏற்றுக்கொள்ளப்பட்டது. அதற்கான தேதிகள் பின்னர் அறிவிக்கப்படும்.
அனைத்திந்திய நிர்வாகிகள் தேர்வும் ஒரு மனதாக நடந்தேறியது. தோழர் P S ராமன்குட்டி அவர்கள் மீண்டும் தலைவராக தேர்ந்தெடுக்கப்பட்டுள்ளார். துணை தலைவர்களாக தோழர் DG , மற்றும் G.நடராஜன் ,பொது செயலாளராக கர்நாடக மாநிலத்தை சார்ந்த தோழர் P .கங்காதரராவ் , துணைப்பொது செயலாளர்களாக தோழர் முத்தியாலு மற்றும் ஆந்திரா மாநிலம் தோழர் வரப்பிரசாத ராவ் அவர்களும் தேர்ந்தெடுக்கப்பட்டனர். பொருளாளராக தோழர் TS விட்டோபன் அவர்களும் துணை பொருலாளராக தோழர் ராமராவ் அவர்களும் தேர்ந்தெடுக்கப்பட்டுள்ளனர். AGS ஆக நெல்லை மாவட்ட செயலர் தோழர் S .அருணாசலம் மீண்டும் தேர்வாகி உள்ளார். மற்றும் தோழியர் V. ரத்னா சென்னை தொலைபேசி அவர்கள் AGS ஆக தேர்ந்தெடுக்கப்பட்டுள்ளார்.
சமீபத்தில் கேரளாவில் நிகழ்ந்த வரலாறு காணாத வெள்ளத்திற்கு நிவாரண நிதியாக ரூபாய் ஒரு லட்சம் நன்கொடையாக வழங்கிய கோவை தோழியர் சிவகாம சுந்தரி அவர்கள் விழா மேடையில் ஒடிஷா மாநில பாரம்பரிய முறையில் பாராட்டி கௌரவிக்கப்பட்டார் .
இந்த மாநாட்டின் ஒரு சிறப்பு அம்சமாக 98 வயது நிரம்பிய ஒடிஷா மாநிலம் கட்டாக் நகரைச்சார்ந்த பெரியவர் சைதன்ய பெஹெரா அவர்கள் பாராட்டி கௌரவிக்கப்பட்டார் . 1921 ஆம் வருடம் பிறந்துள்ள இவர் கைத்தடி இல்லாமல் , யாருடைய உதவியும் இல்லாமல் தாமே நடப்பது போற்றுதற்குரிய விஷயம். மொத்தத்தில் நம் அமைப்பு ஓய்வூதியர் மத்தியில் ஒரு பலமான அமைப்பாக இருக்கிறோம் என்பதை மெய்ப்பித்தது. சென்ற மாநாட்டிற்குப் பிறகு நமது சங்கம் 104.49 சதவீத வளர்ச்சி பெற்றுள்ளதாக தோழர் DG அறிவிக்க அனைவரின் கரவொலி விண்ணைப் பிளந்தது.
நம் மாநிலச் செயலர் தோழர் RV தமது பரப்புரையில் தமிழ் மாநில உறுப்பினர் எண்ணிக்கை பத்தாயிரத்தினைத் தாண்டிவிட்டது. நம் லட்சியம் அடுத்த மாநாட்டிற்குள் பதினைந்தாயிரத்தை தொட்டுவிடுவோம் என்று பலத்த கரகோஷங்களிடையே தெரிவித்தார். நம் வளர்ச்சி விகிதம் சுமார் 140 சதவீதமாகும்.
இறுதியாக, சிறப்பான முறையில் நல் வசதிகளுடன் நாம் தங்குவதற்கு சிறப்பான முறையில் ஏற்பாடுகள் செய்திருந்த வரவேற்பு குழுவிற்கு நன்றி பாராட்டப்பட்டது. வயிற்றுக்கு சங்கடம் தராத சுவைமிகு ஒடிஷா பாரம்பரிய உணவு வழங்கிய சமையற்கலைஞர்கள் கௌரவிக்கப்பட்டார்கள்
