Cases at Ernakulam CAT

1. Pension Fixation @ 78.2% IDR and arrears w.e.f. 01-01-2007 : Case No. OA 338/18 at Ernakulam CAT, Kerala

The case came for hearing at Ernakulam CAT on 28-02-2019. The respondents have not yet filed their counter. Last Chance has been given to the respondent to file reply within two weeks.

2. Pre-2006 pensioners case : Case No. OA 346/18 at Ernakulam CAT, Kerala

All BSNL pensioners retired before 2006 also should get their pension refixed at 50% of Last Pay Drawn at par with other central government pensioners;.

Listed for 27-02-2019. But, not taken up for hearing. Respondents had filed their counter. Next date will be known shortly.

Extra increment case came for hearing today as 17th case.

Honourable Two bench judge postponed the case for hearing to 6th March 2019.

CDA increases 3% from 1-1-2019

Dearness Allowance for Central Government Employees increased to 12% – Union Cabinet decides to increase DA from January 2019 from 9% to 12 % – Net increase will be 3% – Finance Minister Sri. Arun Jaitley announces Cabinet’s decision.

While briefing the press on various decisions taken by Cabinet on 19.02.2019, Finance Minister announced that Central Government Employees DA from January 2019 will be increased to 12% and that 3% increase in DA from January 2019 would cost Rs. 9200 Crore to Government.

Central Government Pensioners would also benefit by this Cabinet’s decision to increase DA from January 2019.

More than 1 crore Central Government Employees and Central Government Pensioners will be receiving this additional installment of Dearness Allowance.

19-02-2019 ஆர்ப்பாட்டம்

19-02-2019: BSNL ஊழியர்களின் 18-02-2019 முதல் 20-02-2019 வரையிலான 3-நாள் வேலைநிறுத்தத்திற்கு ஆதரவு தெரிவித்து, நமது AIBSNLPWA தூத்துக்குடி மாவட்டம் சார்பாக, GM அலுவலகம் முன்பு காலை 11:00 முதல் 12:30 வரை ஆர்ப்பாட்டம் நடத்தப்பெற்றது.

ஆர்ப்பாட்டத்திற்கு மாவட்ட உதவித் தலைவர் எம்.ஜீவானந்தம் தலைமையேற்றார்.

வேலைநிறுத்தம் ஏன் என்பது குறித்தும், மத்திய அரசுகள் மேற்கொண்டு வரும் BSNL விரோதப் போக்கினால் படிப்படியாக இழப்பை நோக்கி நகரும் அவலத்தை எடுத்துக் கூறியும், BSNL ஊழியர்களின் நியாயமான 8 அம்ச கோரிக்கைகளை விளக்கியும், தோழர்கள் எஸ்.பாலு (AIBSNLPWA), அந்தோணி பிச்சை (SNEA), பாலக் கண்ணண் (NFTE), சொர்ணராஜ் (SNEA) ஆகியோர் உரையாற்றினார்கள்.

AIBSNLPWA மாநில உதவிச் செயலர் எம்.அம்பிகாபதி கோரிக்கைகளை விளக்கிப் பேசினார்.

மாவட்டச் செயலாளர் எஸ்.சுப்பையா நன்றியுரை கூற, ஆர்ப்பாட்டம் சிறப்பாக நடந்தேறியது.

காரிலும் ஆட்டோவிலும்,   பிறர் கைத்தாங்கலாக கோல் ஊன்றி வந்தாலும் , நியாயமான போராட்டத்தில், சுட்டெரிக்கும் வெயிலும் எங்களுக்குப் பொருட்டல்ல, நாங்கள் முன்னிற்போம் என்று வந்து கலந்துகொண்ட நமது ஓய்வூதியர்களை எண்ணி பெருமிதம் கொள்கிறோம்.

போராட்டத்தில் திரளாக வந்திருந்து கலந்துகொண்ட 70 ஓய்வூதியர்  தோழர்களுக்கு நன்றியையும் வாழ்த்துக்களையும் தெரிவித்துக் கொள்கிறோம்.

இன்று இரவு 7:00 மணியளவில் 

தோழர்கள் எம்.ஜீவானந்தம் (மா.துணைத் தலைவர்),

எம்.பர்னபாஸ் (மா.இணைச் செயலர்),

ஆகியோர் அவரது சிதம்பரநகர் அலுவலகத்தில் சந்தித்து CHQ வின் குறிப்பாணையைத் ((memorandum) தந்தோம்.

"BSNL உருவாகும்போதே மத்திய அரசின் பென்சன் கணக்கீடு மற்றும் அனைத்து சலுகைகளும்  உங்களுக்குத் தருவதாக அரசு வாக்குறுதி தந்ததனால்தானே நீங்கள் BSNL ல் இணைந்தீர்கள். 

BSNL வேண்டும் என்று நீங்கள் கேட்கவில்லையே. 

அரசுதானே அதை உருவாக்கி உங்கள்மீது திணித்தது. கொடுத்த வாக்குறுதியை அரசு இப்போது எப்படி மீறமுடியும்"  

என்று எடுத்த எடுப்பிலேயே பிரச்சனையின் சாராம்சத்தை அவர் பேசியதுடன், "எனது ஆதரவு உங்களுக்கு உண்டு. நான் பரிந்துரை செய்து கடிதம் தயார்செய்து விரைவில் தருகிறேன்" என்ற மகிழ்ச்சியான தகவலையும் தந்தார்.

திரு.J.J.T.நட்டர்ஜி அவர்களிடமிருந்து,
மாண்புமிகு தொலைத்தொடர்பு அமைச்சர் திரு. மனோஜ் சின்ஹா அவர்களுக்கு
எழுதிய பரிந்துரைக் கடிதம் கிடைத்தது.

கடிதம் தொலைத்தொடர்பு அமைச்சருக்கு விரைவில் அனுப்பி வைக்கப்படும். 

KANYAKUMARI CWC Decisions & Our move ...PSR

CWC declared full support and solidarity to the serving staff and their unions in their efforts to get a reasonable and decent wage revision. CWC called upon branches to extend all possible help and support wherever possible. Based on information received through whatsapp, CWC felt that the AUAB may be forced to make some understanding for pay revision with 0% or 5% fitment and such an understanding between BSNL company and the staff unions in no way is binding on pension revision which is entirely a different issue to be decided by the Department of Telecom. 

Hence, we shall continue vigorously our efforts to get pension revision with CPC fitment benefits. No benefit shall come to us automatically or as Grace. 

CWC authorised the CHQ Secretariat to take appropriate actions at the appropriate times to realise our just demand for pension revision. Though it is time consuming and costly, legal remedy also can be considered as the last resort. 

CWC called upon branches to approach MPs and enlist their support to our efforts and demand. Efforts may be made to submit the memorandum on our demand to the Prime Minister wherever he visits different places during election campaign. 

CWC directed the CHQ to hold a National Convention of BSNL/MTNL pensioners in New Delhi in consultation with CBMPA constituents. .Efforts should be made to ensure participation of leaders of all central trade unions in the Convention. 

CWC expressed its anger and anguish over the most negative and recalcitrant attitude of bureaucrats in DoT explicitly expressed by not submitting concrete proposal on pension revision as required by the Department of Pension & Pensioners Welfare. [Decisions taken on organizational matters and the resolutions adopted by CWC on other issues like MRS, CGHS, CCA office staffing etc. will be circulated through the next Circular from CHQ.]

WAGE REVISION IN BSNL 

Comrades, BSNLEU CHQ has given some information about the latest position with regard to wage revision in BSNL. Neither NFTE nor the SNEA website shows anything till 1200 hours on today, 15-2-2019. According to BSNLEU Website, the Management offers wage revision with ZERO Percent benefit immediately; thereafter Minister will go to cabinet for approval to grant 5%. Union now demands minimum benefit of 10% fitment. 

Even if there is any agreement on 0% or 5% or 10% (I wish them the best) that has no impact on our pension revision. Nothing will come automatically to us. DoT will take time and go to cabinet for pension revision. If any understanding is reached with AUAB on fitment benefit in wage revision that will be used against us. Legally it is not binding on us. Pensioners are not party to the understanding on wage revision. 

A Company may give wage increase based on its affordability. Government cannot be led by that formula. The Govt is not under BSNL. We are covered by CCS Pension Rule 1972. PRC report or any formula suggested by PRC is not applicable to those covered by CCS Pension Rule 1972.

 So, as decided by Kanyakumari CWC, we shall continue our efforts more vigorously to realize our just demand for PENSION REVISION WITH CPC FITMENT BENEFIT as granted to all others covered by the CCS Pension Rule of 1972.

LET US MOVE ON.... 

CWC meeting at Kanyakumari is over. CWC decided to continue our efforts vigorously to achieve Pension Revision with CPC fitment benefits. ..... Service Unions in BSNL may strike a deal on PAY Revision with 0% or 5% fitment. That has no effect on our pension revision. ...Nothing will come to us automatically. .... Nothing comes as grace. Understanding between BSNL and AUAB is not binding on us. We are not party to any such understanding. AUAB doesnot represent pensioners. 

.... Govt need not follow decision of the BSNL company. 

.... Meet MPs and enlist support for our demand. 

.... We will hold a national convention in Delhi soon participating national trade unions. Date and venue will be decided in consultation with CBMPA constituents. 

.... It is a prolonged struggle. We want a permanent solution.

கன்னியாகுமரி - மத்திய செயற்குழுக் கூட்டம்

மத்தியச் செயற்குழு அமர்வு - கன்னியாகுமரி

நாள் : 13-02-2019 மற்றும் 14-02-2019 

13-02-2019 அன்று காலை 10:00 மணிக்கு அ.இ.தலைவர் தோழர் இராமன் குட்டி சங்கக் கொடியினை ஏற்றிக் கூட்டத்திற்குத் தலைமையேற்றுத் தொடக்கிவைத்தார்.

கூட்டத்தில் 29 அகில இந்திய நிர்வாகிகளும் 15 மாநில நிர்வாகிகளும் கலந்துகொண்டனர். 

முதன்மையாக, கூட்டத்தில் நமது முக்கிய கோரிக்கையான 7வது சம்பளக் குழு அடிப்படையிலான ஓய்வூதிய மாற்றம் குறித்து ஆழமாக விவாதிக்கப்பட்டது. 

13-02-2019 அன்று காலை, அகில இந்தியப் பொதுச் செயலாளர் தோழர் பி.கங்காதரராவ் அவர்கள், பூரி மாநாட்டுக்குப் பிந்தைய செயல்பாடுகளை விளக்க உரையாகத் தந்தார். நண்பகலுக்கு அடுத்து அனைத்து மாநில நிர்வாகிகளும் மாநிலச் செயல்பாட்டு உரைகளைத் தந்தனர். 

08-02-2019ல் புது தில்லியில் நடைபெற்ற மாபெரும் பேரணி குறித்தும் அதில் பெருமளவு கலந்துகொண்ட அரியானா, உ.பி மற்றும் புதுதில்லி MTNL ஓய்வூதியர்களின் பங்கு குறித்தும் வெகுவாகச் சிலாகிக்கப்பட்டது. 

14-02-2019 காலை மாலை இருவேளையிலும் ஓய்வூதியர் மற்றும் BSNLல் நடைபெற்றுவரும் நிகழ்வுகள் ஆழமாக விவாதிக்கப்பட்டன. இதில், அகில இந்திய நிர்வாகிகளும் மாநில நிர்வாகிகளும் தங்கள் தங்கள் கருத்துக்களை முன்வைத்து விவாதத்தில் பங்கேற்றனர். 

மேலும், பத்ரிகா, மருத்துவப் படி குறித்த விவாதங்கள் சிறப்பாக மேற்கொள்ளப்பட்டன. 

பூரி மாநாட்டில் மேற்கொண்ட முடிவின்படி, 22-11-2018 அன்று உண்ணாவிரதப் போராட்டத்தை வெகு சிறப்பாக மேற்கொண்ட அனைத்து கிளைகளுக்கும் பாராட்டு தெரிவிக்கப் பெற்றது. ஏறக்குறைய 35000 அஞ்சலட்டைக் கோரிக்கைகள் பாரதப் பிரதமருக்கு அனுப்பி வைக்கப்பட்டமைக்கு வாழ்த்து தெரிவிக்கப்பட்டது.

8 ஓய்வூதியர் சங்கங்கள் இணைந்த CBMPA குழுவின் சிறப்பான செயல்பாடுகள் பாராட்டப்பெற்று, நமது ஓய்வூதியக் கோரிக்கை வென்றெடுத்த பின்னரும், கூட்டுக் குழுவினத் தொடர்ந்து நடத்தவும் முடிவு செய்யப்பட்டது. 

அ.இ.தலைவர், பொதுச்செயலர், தமிழ் மாநிலச் செயலர் மற்றும் சென்னையில் உள்ள அ.இ.நிர்வாகிகள் ஆகிய 10 பேர் இணைந்த தலைமைச் செயலகம் (SECRETARIAT) ஏற்படுத்தப்பெற்று, தற்போதைய சூழலில் அவசர முடிவுகள் எடுத்து நடவடிக்கை மேற்கொள்ள அனுமதி அளிக்கப்பட்டது. 

பெங்களூரில் நமது மத்தியத் தலைமையகம் செயல்பட வாடகையில்லாத இடவசதி ஒதுக்கித் தந்த NFTE பெங்களூர் சங்கத்திற்கு நன்றி தெரிவிக்கப்பட்டது. கணிணி மற்றும் பிரிண்டர் தந்த தோழர் பாபுவுக்கும் நன்றி தெரிவிக்கப்பட்டது. 

மாநில மற்றும் மாவட்டச் செயலர்களுக்கு 2 பிரதி வீதம் பத்ரிகா அனுப்ப முடிவு செய்யப்பட்டது. இரண்டாவது பதிப்பாக, 2000 பிரதிகள் ‘PENSION IS RIGHT' நூல் புதிய திருத்தங்களுடன் அச்சடிக்கப்படத் தீர்மானிக்கப்பட்டது.

தணிக்கை செய்யப்படாத வரவு செலவும் அ.இ.பொருளாளரால் வாசிக்கப்பெற்று கூட்டத்தில் முன் வைக்கப்படடது. 

இரண்டாவது நாள் முடிவு செய்யப் பெற்ற வெகு சிறப்பான தீர்மானங்களுடன், மாலை 5:00 மணிக்கு, கூட்டத் தலைவரால் தேதி குறிப்பிடப்படாமல் மத்தியச் செயற்குழுக் கூட்டம் ஒத்தி வைக்கப் பட்டது.

சங்க அலுவலகத்தில் நடைபெற்றது.

மாவட்டத் தலைவர் திரு.எல்.தாமஸ் அவர்கள் கூட்டத்திற்குத் தலைமையேற்றார். கூட்டத்தில் மாநிலத் துணைச் செயலர் என்.அம்பிகாபதி, மாவட்டத் துணைத் தலைவர் எம்.ஜீவானந்தம், , மாவட்ட இணைச் செயலர்கள் எம்.பர்னபாஸ், கே.சித்திக் உமர், மாவட்டப் பொருளாளர் எஸ்.பால்சாமி ஆகியோர் ஓய்வூதிய மாற்றம் சம்பந்தமான தற்போதைய நிகழ்வுகள் குறித்து விரிவாகப் பேசினர். 

கூட்டத்தில் கீழ்க்கண்டவை குறித்த விவாதங்கள் நடந்தேறின: 

1) 29-01-2019ல் நடைபெற்ற CBMPA கூட்டத்தில் முடிவு செய்யப்பெற்ற தீர்மானங்கள் குறித்து விரிவாகப் பேசப்பட்டது. 

1a) CBMPA கூட்டத்தில் தீர்மானிக்கப் பெற்றபடி நமது தூத்துக்குடி மாவட்டச் சங்கத்தின் உறுப்பினர்களிடமிருந்து பெறப்பட்ட 217 கோரிக்கை அஞ்சல் அட்டைகள் அனுப்புவதற்குத் தயாராக உள்ள செய்தி தரப்பட்டது. 

1b) 8-2-2019 அன்று புது தில்லியில் நடைபெற்ற மாபெரும் பேரணி குறித்த செய்தி பெருமையுடன் பரிமாறப்பட்டது. 

1c) நமது மாவட்டத்தின் பாராளுமன்ற உறுப்பினர் திரு.நட்டார்ஜி அவர்களைச் சந்தித்து ஓய்வூதியம் சம்பந்தமான குறிப்பாணையைத் தந்து அவருடைய ஆதரவைப் பெறுவது குறித்த தகவல் விவாதிக்கப்பட்டது. 

2) சிறப்பாக நடைபெற்றுவரும் வாட்ஸ்-ஆப்பில் நமது உறுப்பினர்களின் கடமை மற்றும் பொறுப்பு குறித்த விவாதத்தில் உறுப்பினர் அனைவரும் தங்கள் சிறப்பான கருத்துக்களைத் தெரிவித்தனர். 

3) வருகிற 8-3-2019 அன்று மகளிர் தின விழாவினைச் சிறப்பாக நடாத்துவது குறித்து விவாதிக்கப்பட்டது. 

கூட்டத்திற்கு 16 உறுப்பினர்கள் வருகை தந்து சிறப்பித்தனர். 

Pension Anomaly Case hearing at Delhi High Court

Our Pension Anomaly case, bearing No. WP(C)10019/2017, was listed in Court No 4 at Item 7,  in Delhi High Court under  "After Notice Misc Matters " before Hon'ble Mr Justice Vipin Sanghi & Hon'ble Mr Justice A K Chawla on 08-02-2019. 

Our turn came after lunch at about 3:00 PM.  The Hon'ble court heard  advocates of both sides for about half an hour .
Today our  case was " part  heard "  and further time was not available since the Hon'ble Judges were to attend some other Special Bench. 

Next Date of Hearing is fixed on 18.07.2019 after about five months. 

We are hopefull that the case  shall get completed on 18.07.2019 in the High Court.

29-01-2019 அன்று நடந்த CBMPA  கூட்டத்தில் எடுக்கப்பெற்ற முடிவுகளின்படி (குறிப்பு எண் 4),  08-02-2019 அன்று 2000 ஓய்வூதியர்கள் கலந்துகொண்ட மாபெரும் பேரணி புது தில்லியில் நடைபெற்றது. நமது சங்கம் உட்பட BSNL, MTNL ஓய்வூதியர் இணைந்த சங்கங்கள் இந்தப் பேரணியில் கலந்துகொண்டன.

DOT makes crisis in BSNL?

First Batch of  244 KYP Forms had already been submitted on 08-10-2018 & this is the 2nd Batch of 86 KYP Forms submitted by hand directly at the O/o.CPPC, Chennai on 30-01-2019.

Totally, we have submitted 330 KYP forms.
